1. Agreement to Terms

By accessing or using Bibbly ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service. These Terms apply to all users of the Service, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content.

The Service is operated by LabRats Inc. ("we," "our," or "us"). By using Bibbly, you agree to comply with and be bound by these Terms.

2. Use of the Service

2.1 Eligibility

You must be at least 13 years old to use Bibbly. By using the Service, you represent and warrant that you are at least 13 years old and have the legal capacity to enter into these Terms.

2.2 Account Registration

To use certain features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and update your account information to keep it accurate
• Maintain the security of your account credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

2.3 Acceptable Use

You agree not to:

• Use the Service for any illegal purpose or in violation of any laws
• Harass, abuse, or harm other users
• Impersonate any person or entity or falsely state your affiliation with any person or entity
• Upload or transmit any content that is offensive, defamatory, or violates the rights of others
• Interfere with or disrupt the Service or servers connected to the Service
• Attempt to gain unauthorized access to the Service or any related systems or networks
• Use automated systems (bots, scrapers) to access the Service without permission
• Reverse engineer, decompile, or disassemble any part of the Service

3. User Content

You retain ownership of any content you submit, post, or display on or through the Service ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and distribute such content solely for the purpose of operating and providing the Service.

You are solely responsible for your User Content and the consequences of posting it. We reserve the right to remove any User Content that violates these Terms or is otherwise objectionable in our sole discretion.

4. Proximity Detection and Connections

Bibbly uses Bluetooth Low Energy (BLE) to detect when you are in proximity to other Bibbly users. By using the Service, you understand and agree that:

• Proximity detection requires Bluetooth to be enabled on your device
• Encounter data is stored locally and synced to our servers
• Connection requests require mutual consent from both parties
• You can opt out of proximity detection at any time in app settings
• We do not track your precise location or movement patterns

5. Premium Features

Bibbly may offer premium features through in-app purchases ("Bibbly Plus"). If you purchase a subscription:

• Payment will be charged to your account at confirmation of purchase
• Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage subscriptions and turn off auto-renewal in your account settings
• No refunds will be provided for any unused portion of a subscription period

6. Intellectual Property

The Service and its original content, features, and functionality are owned by LabRats Inc. and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

The Bibbly name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of LabRats Inc. You may not use such marks without our prior written permission.

7. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free, or that defects will be corrected. We do not guarantee that the Service will meet your requirements or that the results obtained from using the Service will be accurate or reliable.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LABRATS INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.

9. Indemnification

You agree to defend, indemnify, and hold harmless LabRats Inc. and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Service or your violation of these Terms.

10. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will cease immediately.

You may terminate your account at any time by deleting the app or contacting us. Upon termination, we will delete your account and associated data in accordance with our Privacy Policy.

11. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use the Service after those revisions become effective, you agree to be bound by the revised Terms.

12. Governing Law
